Although the OEE applies to a wide range of industrial and agricultural products, sanitary and phytosanitary measures and government procurement specifications are covered by separate agreements. OEE rules help distinguish between legitimate standards and technical rules and protectionist measures. Standards, technical rules and conformity assessment procedures must be developed and applied in a non-discriminatory manner, developed and applied in a transparent manner and, where appropriate, based on relevant international standards and guidelines. 10.7 Where a Member has concluded an agreement with another country or countries on matters related to technical regulations, standards or conformity assessment procedures that may have a significant impact on trade, at least one Member of the Contracting Party, through the Secretariat, shall communicate to other Members the products to be covered by the Agreement and provide a brief description of the Agreement. The Members concerned shall be invited, upon request, to enter into consultations with other Members with a view to concluding similar agreements or organising their participation in such agreements. 6.3 Members are encouraged to be prepared, at the request of other members, to enter into negotiations with a view to concluding agreements on the mutual recognition of the results of each other`s conformity assessment procedures.
